Recent Illinois Case: Rosmarin v. Arnstein & Lehr

This recent case held that where attorney’s allegedly negligent estate planning advice results in overpayment of estate taxes, the limitations period expires two years after the client’s death, pursuant to 735 ILCS 5/13-214.3(d).  In such situations, the discovery rule set forth in 735 ILCS 5/13-214.3(b) does not apply.
